The Dutch Probation Service used a faulty algorithm that wrongly classified 80,640 people. With the Supreme Court ruling now final, victims can claim compensation.
The Oxford Risk of Recidivism (OxRec) algorithm was used by Dutch Probation to calculate re-offending risk. This advice is decisive for judges in granting conditional release, contact bans, and even TBS orders.
On 12 February 2026, the Inspectorate of Justice and Security concluded the algorithm was seriously flawed:
